This tool ("PROOF," the "Tool") is operated by Digital Edge Media LLC ("Digital Edge," "we," "us"). By accessing or using the Tool, you agree to these Terms of Use and Privacy Policy. If you do not agree, do not use the Tool.
The Tool runs entirely in your web browser. Images, logos, and text you provide are processed locally on your device to generate artwork and assemble email text. This content is not transmitted to, uploaded to, or stored on any Digital Edge server. We do not operate user accounts and do not collect personal information through the Tool.
The Tool loads a small number of third-party resources to function: web fonts (via Google Fonts) and a file-bundling library (via a public CDN). Your use of those resources is subject to the respective providers' terms and privacy practices. Any files you download or email content you copy remain on your device and under your control.
You are solely responsible for the photos, logos, artist names, marks, and other materials you upload or enter into the Tool ("Your Content"). By using the Tool, you represent and warrant that you own Your Content or have all rights, licenses, and permissions necessary to use it for the artwork and communications you create.
You agree to indemnify and hold harmless Digital Edge from any claims, damages, or liabilities arising out of Your Content or your use of the Tool, including any claim that Your Content infringes the rights of a third party.
The Tool — including its code, design, layout, templates, and underlying intellectual property — is owned by Digital Edge Media LLC and is protected by applicable intellectual property laws. Using the Tool grants you a limited, revocable, non-exclusive license to use it for its intended purpose. It does not transfer to you any ownership of the Tool, its templates, or any related intellectual property, and does not grant any right to copy, resell, reverse-engineer, or redistribute the Tool.
As between you and Digital Edge, you retain rights to the final artwork and email content you generate using the Tool, to the extent you hold rights in Your Content. Digital Edge claims no ownership of the show artwork or advance communications you produce.
You agree not to use the Tool for any unlawful, infringing, deceptive, or harmful purpose, and not to use it to create or distribute content that violates the rights of others or applicable law.
The Tool is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Tool will be error-free or uninterrupted. To the fullest extent permitted by law, Digital Edge will not be liable for any indirect, incidental, or consequential damages arising from your use of the Tool.
Fonts and libraries used by the Tool are provided by their respective owners under their own licenses. Those assets remain the property of their providers.
We may update these terms from time to time. Continued use of the Tool after changes are posted constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles.
